These Terms govern your access to the BORZ.FIT website, membership, content and private community, collectively referred to as the “Service”. In these Terms, “we”, “us” and “our” refer to BORZ.FIT, while “you” and “your” refer to each visitor or member using the Service.

By visiting the website, purchasing a membership or using any part of the Service, you confirm that you have read, understood and agreed to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

The Service provides access to a private fitness community, coach-led areas, educational resources, discussions, live sessions and other membership features that may be introduced or changed over time.

Membership gives you access to the Service; it does not create an employment, partnership, agency, medical, fiduciary or personal coaching relationship between you and us or any participating coach.

You must meet the minimum age required to use Discord in your country and have the legal capacity to enter into a binding agreement.

If you are under the age of legal majority where you live, you may use the Service only if a parent or legal guardian authorizes the purchase, supervises your use of the Service and accepts these Terms on your behalf.

You may use the Service only where doing so is lawful.

You are responsible for providing accurate information, keeping your login credentials and membership links confidential, and for all activity occurring through your account. You must notify us promptly if you suspect unauthorised access or misuse.

Accounts and membership access are personal and may not be sold, transferred, shared or made available to another person.

The Service is offered through a recurring membership. The price, billing interval, applicable taxes and payment details are displayed at checkout. By subscribing, you authorise the payment provider to charge the selected payment method at the start of each billing period until cancellation.

Access is granted after successful payment and remains active while the subscription is in good standing. If a payment fails, access may be restricted or suspended until payment is successfully completed.

You may cancel through the payment portal at any time. Cancellation must be completed before the next billing date to avoid being charged for the following billing period. After cancellation, access may continue until the end of the period already paid for.

Because digital membership and community access are made available immediately, payments are generally non-refundable except where a refund is required by applicable law. If you believe you were charged incorrectly or exceptional circumstances apply, contact contact@borz.fit. Any discretionary request will be reviewed individually.

The Service provides general fitness and nutrition education and community guidance. It does not provide medical advice, diagnosis, treatment or emergency services and is not a substitute for advice from a qualified healthcare professional.

Before beginning or changing an exercise, nutrition or supplementation program, consider your individual health, experience and circumstances and seek professional advice where appropriate. Stop exercising and seek medical assistance if you experience pain, dizziness, breathing difficulty or other concerning symptoms.

Testimonials, transformations and examples describe individual experiences and are not promises or guarantees. Results vary according to factors including effort, consistency, health, genetics, experience, nutrition and personal circumstances.

We do not guarantee any particular physical, health, performance, social, professional or financial outcome.

You must communicate respectfully and follow all posted rules and moderator instructions. You may not harass, threaten, stalk, defame or impersonate others; publish unlawful, obscene, discriminatory or infringing content; distribute malware or spam; collect member information without permission; advertise without authorisation; or interfere with another person's use of the Service.

We may review or remove content and restrict participation where reasonably necessary to protect the Service, its coaches, members or reputation.

You may not use the Service for an unlawful or unauthorised purpose, attempt to bypass access controls, probe or disrupt security, scrape or automatically extract information, reverse engineer any protected technology, interfere with operation, misrepresent your identity, facilitate fraud or help another person violate these Terms.

The Service and its original content, branding, graphics, videos, training materials, community resources and other protected elements belong to us, participating coaches or our licensors. Your membership grants a limited, personal, non-exclusive, non-transferable and revocable right to access them while your membership is active.

You may not copy, record, reproduce, republish, distribute, resell, sublicense, modify or commercially exploit protected content without prior written permission from the relevant rights holder.

You remain responsible for messages, photos, progress updates, feedback and other content you submit. You confirm that you have the right to share it and that it does not violate another person's rights or applicable law.

By submitting content within the Service, you give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display it only as reasonably necessary to operate, moderate and improve the Service.

Parts of the Service may rely on third parties such as payment processors, Discord, hosting providers or other platforms. Their services are governed by their own terms and privacy policies. We do not control and are not responsible for their independent operation, availability, security or content.

By using the Service or contacting us electronically, you agree that account notices, receipts, service updates and other communications may be delivered by email, through the website, through the Community or by another reasonable electronic method.

We reserve the right, in our sole discretion, to suspend or terminate your access to all or part of the Service, remove content or restrict participation at any time, with or without notice, for violating these Terms, failing to pay, disrupting the Community, engaging in conduct we consider harmful or inappropriate, or for any other lawful reason.

Termination does not remove obligations or rights that by their nature should continue, including payment obligations, intellectual property protections, disclaimers and limitations of liability.

We may update, replace, remove or add coaches, content, features, schedules, channels and third-party tools. We may also temporarily interrupt access for maintenance, security, technical issues or circumstances beyond our reasonable control.

We do not guarantee uninterrupted, error-free or permanently available access to every feature, coach or piece of content.

To the maximum extent permitted by applicable law, the Service is provided on an “as available” basis. We do not make warranties beyond those that cannot legally be excluded.

To the maximum extent permitted by applicable law, we and participating coaches will not be liable for indirect, incidental, special or consequential loss arising from use of or inability to use the Service.

To the extent permitted by applicable law, you are responsible for losses, claims or costs arising from your unlawful use of the Service, your content, your violation of these Terms or your infringement of another person's rights.

We may update these Terms & Conditions to reflect changes to the Service, our practices or applicable requirements. The revised version becomes effective when posted unless another effective date is stated. Where appropriate, we may provide additional notice of material changes.

Your continued use of the Service after the updated Terms take effect means you accept the revised Terms.

If any provision of these Terms & Conditions is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision does not waive our right to enforce it later. You may not transfer your rights or obligations under these Terms without our written permission.

These Terms & Conditions, together with the Privacy Policy and any rules or notices displayed within the Service, form the agreement between you and us regarding your use of the Service.
